Modification of Child Support, Custody and Alimony in Denver Colorado
Denver CO Divorce Lawyers – Family Law Attorneys
It is understandable that you would be relieved on the day when your divorce becomes final, and there is nothing wrong with enjoying that sense of relief for a while. However, the Colorado Statutes provide for modifications of the original terms of the dissolution of marriage decree if certain conditions are met. This is one of the reasons why it is not advisable to go through a divorce proceeding without the representation of a licensed Colorado divorce lawyer. For example, it is possible to enter into a privately constructed alimony agreement with your former spouse that cannot be modified in the future if he or she refuses to make the changes voluntarily.
The most common type of modification after the fact is going to involve the child support payment amount. It is very likely that the financial capabilities of both parties are going to change over time. If these changes, when applied to the Colorado state child support guidelines, would result in a difference of at least 10% over the existing payment amount a modification may be in order. Child support modifications can also be appropriate in cases when the needs of the child or children involved change significantly.
Child custody can be modified as well if a material change of circumstances that is detrimental to the well being of the child or children can be proven. This would be the scenario that may come to mind first, but there are child custody modifications that both parents agree to, for example in cases when there is a discipline problem or when the custodial parent is forced to relocate for some reason.
Alimony or spousal support can also be modified either by mutual agreement or at the discretion of the court. But as stated earlier, the court has no jurisdiction if a private agreement exists that precludes future modifications.
